4.3 The Client is responsible for any damage caused to the yacht during the lease period. Any repairs or replacements required will be charged to the Client.

4.4 The Client must not use the yacht for any illegal or unauthorized activities, including but not limited to transporting illegal substances or engaging in unlawful behavior.

5. Responsibilities of Sydney Smart Cruiser

5.1 Sydney Smart Cruiser will ensure that all yachts provided for lease are in good working condition and meet all safety standards.

5.2 Sydney Smart Cruiser will provide necessary instructions and guidelines for the safe and proper use of the yacht.

5.3 In the event of any issues or malfunctions with the yacht, Sydney Smart Cruiser will make reasonable efforts to address and resolve the problem in a timely manner.

6. Liability

6.1 Sydney Smart Cruiser is not liable for any personal injury, loss, or damage suffered by the Client or any third party arising from the use of the yacht.

6.2 The Client agrees to indemnify and hold Sydney Smart Cruiser harmless from any claims, damages, or expenses arising from the Client’s use of the yacht.

6.3 Sydney Smart Cruiser’s liability for any breach of these terms and conditions, whether in contract, tort (including negligence), or otherwise, shall in no event exceed the total amount paid by the Client for the lease of the yacht.

7. Insurance

7.1 Sydney Smart Cruiser provides insurance coverage for the yachts, which includes public liability and property damage.

7.2 The Client is responsible for any insurance excess applicable in the event of a claim.

7.3 The Client is encouraged to obtain additional personal insurance coverage as deemed necessary.

8. Privacy Policy

8.1 Sydney Smart Cruiser is committed to protecting the privacy of our Clients. Our Privacy Policy outlines how we collect, use, and protect your personal information.

12. Dispute Resolution

12.1 In the event of a dispute arising from the leasing of a yacht, the Client and Sydney Smart Cruiser agree to first attempt to resolve the dispute through informal negotiation.

12.2 If the dispute cannot be resolved through informal negotiation, either party may refer the matter to mediation before resorting to litigation.

13. Force Majeure

13.1 Sydney Smart Cruiser shall not be liable for any failure or delay in performing its obligations under these terms and conditions if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, or government regulations.

14. Severability

15.1 These terms and conditions, together with the Lease Agreement and any other documents referred to herein, constitute the entire agreement between the Client and Sydney Smart Cruiser with respect to the leasing of yachts and supersede all prior or contemporaneous understandings, agreements, representations, and warranties, whether written or oral.
